  • 2.1 Please read these terms and conditions carefully. By ordering (as defined below) you agree to be bound by these terms and conditions.

  • 2.2 Where you communicate on behalf of a company / organisation rather than as an individual, you promise that you have the authority to act on behalf of that entity.

3. DEFINITIONS

  • 3.1 Ordering is the act of booking a collection through our website, on the phone, by SMS or by email.

  • 3.2 User is someone or an entity who has placed an order

  • 3.3 Us is Cleané

  • 3.4 Service Provider(s) is independent dry cleaner(s)

 

4. INTELLECTUAL PROPERTY RIGHTS

  • We are the owner or the licensee of all intellectual property rights on our website. All such rights are reserved.

  • You may print off a copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site.

  • You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

  • Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

  • You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

  • If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

5. AGENCY - PLEASE READ:

  • 5.1 We act as a booking agent for independent dry cleaners, hereafter service providers. The terms and conditions comprise both a contract between you and us regarding the use of our Website and (2) a separate direct contract between you and the Service Provider concerned (and not with us) regarding supply of Services to you.

  • 5.2 While we may attempt to assist with resolution of any complaint or dispute, you acknowledge that any legal recourse against the Service Provider arising from the Services whether for breach of contract or otherwise is against the Service Provider and not against us, notwithstanding anything to the contrary in this agreement or on our Website.

  • 5.3 We do not accept legal responsibility for any acts or omissions of Service Providers in relation the Services.

  • 5.4 Where we describe Service Providers as “vetted” or similar, we are promising only that we have carried out certain checks as specified on our Website at the time you make a Booking and that those checks did not reveal any cause for concern. You acknowledge that in carrying out these checks we are reliant on information supplied by third parties. We cannot guarantee that that information is accurate. Nor can we guarantee that the Service Providers are otherwise suitable for your purposes. You use Service Providers at your risk.

6. LIABILITY

  • 6.1 User understand that there is inherent risk in Cleaning and there is potential for clothing and related items to get lost or damaged. Cleané will do its best to ensure situations like this do not happen, and in the instances they do happen, will work with the User to rectify the situation. Without prejudice to the foregoing, and insofar as allowed under mandatory applicable law, Our service providers liability shall in no event exceed an amount of 10 times the cost of cleaning.

  • 6.2 Before any claim for compensation can be processed for any damage to an item(s), the cleaning team must be given the opportunity to collect the item(s) and attempt to reverse the damage.

  • 6.3 We have taken every care in the preparation of our Site and our Service. However, we will not be responsible for any errors or omissions in relation to such content or for any technical problems you may experience with our Site or our Service. If we are informed of any inaccuracies on our Site or in our Service we will attempt to correct this as soon as we reasonably can. To the extent permitted by law, we exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our Site, our Service, and any website linked to our Site and any materials posted on it. This does not affect our liability for death or personal injury arising from our negligence, or our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.

  • 6.4 A condition for any right to compensation is always that the Customer reports the damage to Cleané’s customer service in writing as soon as possible, but no later than 48 hours after it has arisen.

  • 6.5 In the event of force majeure, Cleané shall not be obliged to compensate the Customer for any damage caused as a result.

  • 6.6 Cleané and our service providers   shall never be liable for any damage resulting from incomplete or incorrect information provided by the Customer.

  • 6.7 Cleané and our service providers are never liable for loss of items (including but not limited to sums of money, jewellery and other valuable items) that were in the Items before they were sent to us.

  • 6.8 Cleané and our service providers are never liable for colour loss or stretching or shrinkage of Items.

  • 6.9 Cleané and our service providers shall never be liable for damage suffered on Items that do not have a proper wash label.

  • 6.10 Cleané and our service providers are never liable for any damage to and by buttons, zippers, decorations, plastics,  etcetera of Items.

  • 6.11 Cleané and our service providers are never liable for damage to and/or shrinkage of all types of curtains (5-7% shrinkage can occur). Due to the effect of sunlight, wear and tear and daily use, curtains can be damaged which only is discovered at the Services.

  • 6.12 Wash & Fold orders:

  • 6.12.1 Washing & Folding Items are not tagged individually, but per order, so Cleané and our service providers are never liable for missing individual items.

  • 6.12.2 All Items are washed at 30 degrees and dried at medium temperature. It is not possible to take into account personal preferences or instructions, unless expressly agreed otherwise due to the high volume of orders.

  • 6.13.3 Cleané and our service providers are never liable for any damage caused by washing and/or drying Items, the individual wash labels are not checked.

  • 6.13.4 The Washing & Folding order will not contain shirts, blouses or Items that need to be steamed. If they are present, these items will be added individually and calculated according to the individual price.

7. COMPLAINTS

  • 7.1 You agree to communicate any complaints to us and not the Valet. You agree to comply with our complaint and other policies on our Website as may be varied from time to time.

  • 7.2 If you have any complaints, please contact us via the contact details shown on our Website.

8. TRANSFER

  • We may transfer all or part of our rights or duties under this agreement provided we take reasonable steps to ensure that your rights under this agreement are not prejudiced. As this agreement is personal to you, you may not transfer any of your rights or duties under it without our prior written consent.

9. PRICES

  • Prices include any applicable VAT or other sales tax unless otherwise stated on the invoice. We reserve the right to change our prices at any time without consent with you.

10. EVENTS OUTSIDE OUR CONTOL

  • No party shall be liable to the other for any delay or non-performance of its obligations under these terms arising from any cause beyond its control including, without limitation,any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion. For the avoidance of doubt, nothing in this clause 10 shall excuse the Customer from any payment obligations under these terms.

11. AVAILABILITY AND DELIVERY

  • Our aim is to ensure you get the best delivery service possible. Unfortunately things do not always go to plan and factors, such as traffic conditions and weather, may occasionally prevent us from achieving our targets in this regard.

12. Our Site And Our Service Change Regularly

  • We aim to update our Site and our Service regularly, and may change the content at any time. If the need arises, we may suspend access to our Site and our Service, or close them indefinitely. Any of the material on our Site or our Service may be out of date at any given time, and we are under no obligation to update such material.
